Legal expenses insurance (Rechtsschutzversicherung) covers the costs that arise when you are involved in a legal dispute: lawyer fees, court costs, fees for expert witnesses and, where applicable, the legal costs of the opposing party. Without this insurance, even a fully justified legal claim can cost several thousand euros – which often leads people to avoid pursuing their rights altogether.
The policy is structured around modules that are usually combined into a package. Private legal protection covers everyday disputes – with neighbours, in consumer contracts or in personal matters. Traffic legal protection applies to disputes involving your vehicle: accident liability, driving licence matters or points on your record. Tenant legal protection assists in disputes with landlords over tenancy termination, utility cost settlements or demands for repairs. Employees can additionally include employment legal protection, which helps in cases of dismissal or wage disputes.
Typically excluded from coverage are intentional criminal acts, disputes that already existed before the policy was taken out (the pre-contractual exclusion), divorce proceedings and inheritance disputes. The latter are considered unpredictable in scope and are generally excluded from standard policies, though some tariffs allow them to be added for an additional premium.
One key feature of Rechtsschutzversicherung is the waiting period: most areas of coverage do not take effect for three months after the policy is signed. Traffic and criminal legal protection often have no waiting period. This mechanism prevents people from taking out a policy only because they are already expecting a specific dispute.
The coverage limit defines the maximum amount the insurer will pay per dispute. Common figures range from 300,000 to 1,000,000 euros. Legal proceedings can become costly, especially in higher courts or complex matters, so a sufficient coverage limit is important.
When comparing tariffs, consider: which modules are included in the package, the level of voluntary excess and whether it can be waived, whether online or telephone legal advice is included, and how disputed refusals of coverage are handled. If your insurer considers a case hopeless, the policy should ideally include a binding arbitration clause allowing an independent expert to reassess the situation.
