Tortious incapacity
Tortious incapacity means that a person is not legally liable under the German Civil Code (BGB) for damage they have caused. Children under 7 are generally not liable; children aged 7–10 are not liable in road traffic situations. In such cases, parents or guardians may be held liable if they failed their duty of supervision. A good liability policy also covers damage caused by children who lack tortious capacity.
